Privacy Policy

1. Information We Collect

NearQuick is a service operated by Aistella LLC. We collect the following information when you use NearQuick:

• Account information: name, email address, and profile picture (if using Google Sign-In)
• Advertisement content: titles, descriptions, images, links, and destination URLs
• Payment information: processed securely via Stripe. We do not store full credit card numbers on our infrastructure.
• Usage data: pages visited, clicks, and search queries
• Technical Compliance Data: To ensure security and maintain evidence of legal agreement, we automatically collect IP addresses, device fingerprints (User Agent), precise timestamps, and interaction telemetry (including specific screen coordinates of checkbox interactions during agreement acceptance). See Section 31 of our Terms of Service for details.

2. How We Use Your Information

We use your information to:

• Operate and optimize our advertising services
• Process financial transactions and issue receipts
• Legal Affirmation: Maintain tamper-evident audit logs of your consent to our Terms of Service and Privacy Policy
• Protect against fraud, malicious bot activity, and platform abuse
• Send essential service-related notifications and administrative updates

3. Processing of Subscription, Private Messaging, and Moderation Data

We process your subscription status, account identifiers, and billing history to manage your active VIP Membership. When you utilize our private messaging interface, we collect and securely store the text content, timestamps, and communication metadata. This message data is processed automatically through algorithmic keyword filtering and pattern screening software to detect scam layouts, phishing links, malware scripts, and prohibited materials. By using the messaging system, you grant the Platform explicit consent to monitor, log, and filter this text to enforce safety guidelines.

4. Information Sharing & Third-Party Data Disclosures

We do not sell your personal information. We share data only with:

• Payment Processors for essential transaction execution via PCI-DSS compliant infrastructure. Our platform never routes or stores sensitive credit card details.
• Telecommunications and Email Service Providers who receive your mobile number and email address via encrypted protocols solely to deliver identity verification codes, delivery receipts, and critical account security notifications. These vendors are contractually prohibited from retaining, selling, or utilizing your data for any secondary commercial purposes.
• Law Enforcement or Regulatory Authorities when required by subpoena, statute, or to defend our legal rights (including chargeback defense)
• Authorized Service Providers who assist in platform operations under strict confidentiality obligations

Strict Carrier Privacy Guarantee: The Platform strictly adheres to US mobile network guidelines. We do not sell, rent, share, or lease your SMS opt-in data, mobile phone numbers, or consent records to external marketers or advertising networks for any secondary commercial use.

5. Third-Party Authentication (Google OAuth 2.0)

When you sign in using Google, we receive your name, email address, and profile picture from Google. We use this information solely to create and manage your NearQuick account. We do not share your Google account data with third parties for marketing or advertising purposes.

Limited Use Disclosure: Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

6. Data Security

We implement industry-standard security protocols to protect your information, including AES-256 encryption, secure HTTPS connections, and cryptographically signed audit logs to protect the integrity of legal agreement records. While we take reasonable measures to protect your data, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

7. Mobile Communications & SMS Privacy Policy

7.1 Collection of Mobile Information

We collect your mobile telephone number when you voluntarily provide it during account registration, identity verification, or profile updates. This mobile data is collected strictly to facilitate account security, deliver One-Time Passwords (OTP), and transmit transactional text notifications requested by you. Users provide their phone number on the ad submission or profile page and agree to the SMS consent terms displayed directly above the submit button.

7.2 Strict No-Sharing and No-Sale Guarantee for SMS Data

The Platform maintains an absolute restriction regarding your mobile information. Notwithstanding any other provision in this Privacy Policy, your mobile telephone number, SMS opt-in consent records, and related telecommunications data will NOT be sold, rented, leased, shared, or disclosed to any third-party marketers, affiliate brokers, external advertising networks, or any other third parties for secondary commercial or marketing purposes under any circumstances.

7.3 Third-Party Service Providers

Your mobile phone number is transmitted securely via encrypted protocols exclusively to our trusted telecommunications infrastructure providers solely for the purpose of executing automated transactional text message delivery. These institutional network vendors are contractually bound by data processing agreements that strictly prohibit them from retaining, using, repurposing, or sharing your mobile information for any objective outside of delivering the messages explicitly commanded by our platform.

7.4 Opt-Out and Rights Revocation

You retain an absolute, legally binding right to revoke your text messaging consent at any time. You can opt-out of receiving automated text messages by replying with the standalone keyword "STOP" to any message received. For technical assistance or clarifications, you may reply with the keyword "HELP". Standard messaging and carrier data rates may apply.

9. Your Rights

You have the following rights regarding your data:

• Access: Request a copy of the personal data we hold about you

• Right to Delete: Request deletion of personal data, subject to legal exceptions outlined in Section 9.

• Right to Non-Discrimination: We will not deny services or change pricing based on your exercise of privacy rights.

11. Data Retention

We retain your account information for as long as your account is active. Ad content is retained for 90 days after expiration for legal compliance purposes. You may request deletion of your account and associated data at any time, subject to the following exceptions:

• Terms of Service acceptance records, including timestamp, IP address, device information, and cryptographic verification data, are retained for a minimum of seven (7) years for legal compliance purposes and cannot be deleted upon request.
• Payment and transaction records are retained for seven (7) years as required by applicable financial regulations.
• Security logs, fraud prevention records, and audit trails are retained for three (3) years.
• Records required by law enforcement order or ongoing legal proceedings are retained for the duration required by such order or proceedings.

12. Children's Privacy

The Service is restricted to individuals at least 18 years of age. We do not knowingly collect personal information from children under 13.
